Terms and Conditions for Credit Card Payments, Services, Electronic Communications,
Privacy and Refund Policies
- General. SEE IMPORTANT DEFINITIONS IN SECTION 2 BELOW.
- These terms and conditions apply to all credit card payments made (whether online, via payment app, by telephone, in person, or in any other manner) to PMB Rentals, LLC or to RTO Rentals, LLC.
- These terms and conditions also apply to Electronic Communications (whether or not in connection with a credit card payment).
- In addition to these terms and conditions, the PMB Rentals, LLC and RTO Rentals, LLC Privacy Policy applies to your use of any PMB Rentals, LLC or RTO Rentals, LLC website.
- By making a credit card payment to PMB Rentals, LLC or to RTO Rentals, LLC, by requesting Electronic Communication(s), and/or by requesting services from PMB Rentals, LLC or RTO Rentals, LLC, you accept these terms and conditions.
- PMB Rentals, LLC or RTO Rentals, LLC may amend these terms and conditions at any time by posting the amendment on its website at least 30 days prior to the effective date of change.
- Definitions. As used in these terms and conditions:
- “Rental Company,” “we,” or “us” refers collectively to PMB Rentals, LLC and RTO Rentals, LLC and all of its agents and/or employees.
- “You” means you, the customer.
- “Account” means your PMB Rentals, LLC or RTO Rentals, LLC account.
- “Service” means any service provided by Rental Company including but not limited to repairs.
- “Electronic Communications” means any electronic transmission of account information and payment communications sent by Rental Company to you or by you to Rental Company such as online access to account and emails relating to payment, disclosures, notices and other communications regarding your account (including, without limitation, any billing statements, notice of the posting of your electronic payments, privacy notices, change-in terms, notifications, and any periodic email communications).
- “Credit cards” includes both credit cards and debit cards.
- “Automatic payments” refers to having your credit card information stored on file in our secure payment transaction portal for charging your card for authorized lease payments, late fees, and/or any other charges as set forth in your Lease Purchase Agreement.
- Authorization. By entering your credit card information online or providing your credit card information to us by phone, by mail, or in person:
- You are representing and warranting to us that you are an authorized user of the credit card and that the associated information entered (account holder name, account number, billing address, etc.) is accurate.
- You authorize Rental Company and/or its affiliates to charge the amount you set in the Recurring Payment Authorization Form on the date set on the Recurring Payment Authorization Form to your credit card, as a recurring transaction, subject to the authorizations set forth herein and in the Recurring Payment Authorization Form. You understand that this authorization will remain in effect until you notify us in writing that it is revoked.
- If you set up automatic payments and store your credit card information in our secure payment transaction portal, then you authorize Rental Company to charge your credit card on the date set and for the amount set in the Recurring Payment Authorization Form for amounts owed to Rental Company pursuant to your Lease Purchase Agreement.
- You also authorize Rental Company to return to your credit card any funds due to you by Rental Company resulting from use of this service.

- Charges
- For each transaction, in addition to the charge you have authorized, your credit card issuer and/or network may assess their customary transaction or handling charge, if any.
- If a charge is declined or reversed by the credit card issuer or network, you agree to pay us a service charge and to reimburse us for all costs of collection, including reasonable attorney fees. Your credit card issuer may also assess its customary charge for such transactions.
- Dishonored Method of Payment and Requests for Payments
- If your credit card issuer or network does not honor an online payment transaction, an over the phone transaction, an in-person transaction, or a recurring transaction for the agreed amount due, then we have the right to charge the amount of any such transaction to your account or to collect the amount from you.
- If your credit card issuer or network does not honor an online payment transaction, your account may become delinquent and subject to our collections process until a proper method of payment is used to pay all open and pending balances.
- If you submit a charge-back claim with your financial institution for a payment made online or over the phone – either a one-time payment or an automatic payment charged to the credit card on file you provided to us – you remain responsible for payment restitution to us for the initial amount of the chargeback as well as any and all fees incurred by us in result to the charge-back claim.
- If your credit card on file does not process at the time of payment and you submit payment by check and the check is rejected for any reason by our financial institution, then you will be responsible for payment restitution to us for the initial amount of the transaction as well as any and all NSF fees incurred by us.
- Confirmation of Payment
- By clicking “Process” you are consenting to receive a one-time electronic confirmation of this payment to the email address you have provided to us.
- If you set up automatic payments, then you consent to us charging your credit card automatically for the agreed amount and to receiving corresponding e-mails from us confirming and/or notifying you of a problem with your payment.
- All transactions are final. Please see our Refund Policy.
- About credit card security
- Your credit card number is sent in encrypted form to our credit card processor. This means humans cannot read it. It also means that if someone is intercepting your internet traffic the card number is scrambled. Only our credit card processing company will be able to read your credit card number.
- We use secure servers (SSL) and extra strong encryption called “tokenization” under strict regulations of PCI compliance. Using your credit card on our site is as secure as any other commercial transaction on the internet.
- Refund Policy
- If we determine a refund is due to you for any reason, it will be posted to your account to satisfy or partially satisfy any amount due. If your account is open but there is no amount due, the refund will be posted to your account as a credit receivable. If your account is closed with no amount due, then a refund will be issued to you. If you paid us with a debit or credit card the refund will be credited to that card. If you paid us with cash, check, or money order, a company check will be issued to you and mailed to your address on file. Refunds will be issued by the corporate office within 10 business days.
- Technical Requirements for Electronic Communications
- In order to make credit card payments online or receive Electronic Communications, you must have access to a personal computer with a 128 bit JavaScript enabled browser, internet access and a valid email account supported by software that enables you to receive Electronic Communications. In order to store Electronic Communications on paper, you will need a printer connected to your computer. You also may store them in your offline files or in an electronic storage device.
- You agree to provide us, and keep current, a valid email address.
- By authorizing a credit card payment online, or by requesting Electronic Communications, you confirm that your system meets these requirements, that you have the capability to access and download or print electronic disclosures, and that your email address is current and valid.
- “Electronic Only” Communications. If you have authorized “Electronic Only” communications, then the following additional terms apply:
- You understand and agree that Rental Company may provide you with all Electronic Communications exclusively online.
- At your request, we will provide you with copies of statements and account information electronically via email or in printed form as requested.
- You may elect to withdraw your consent to receive Electronic Communications (other than confirmation of online credit card payments) at any time by notifying us via email at info@pmbrentals.com that you wish to be removed from email communications.
- If you give or withdraw consent by writing to us or calling us, there may be a delay in implementing your request.
- You may also contact us if you need to update any information relating to a change in your email address.
- Governing Law
- These terms and conditions will be governed by and construed in accordance with the laws of the State of Tennessee (without giving effect to any choice of law principles or rules). The courts located in Henry County, Tennessee will have the exclusive jurisdiction for any dispute or legal action brought in connection with these terms and conditions or any services performed by us.

OUR PRIVACY POLICY
We value your personal privacy. We have been doing business for over twenty years and have never sold our email lists or any other client information. This means that information about you such as your phone number(s), email address, postal address, date of birth, and credit card information will be kept strictly confidential.
We are here to provide the best service a business can offer and would never knowingly betray your trust. We take industry-standard precautions to protect your data but it is impossible to guarantee the security of data transmission over the Internet or any wireless network; therefore, you agree that you use our site and transmit sensitive data to us at your own risk.
We do not share or sell any customer information with or to anyone or any entity what-so-ever. We will transmit information of yours only as necessary to process your payment or provide service to you (for example, we need to send your payment information to our credit card processor). All service providers to whom we transmit your information will also be obligated to keep your data confidential.
